USE OF THE SITE + SERVICE

To access or use the Site, you must be 18 years or older and have the requisite power and authority to enter into these Terms and Conditions. Children under the age of 18 are prohibited from using the Site. But as soon as you turn 18, we’d love to have you!

In order to buy products or receive communication from us, you are required to provide information about yourself including your name, email address, and sometimes a username and password and other personal information. You agree that any registration information you give to Creatively by Donielle will always be accurate, correct, and up to date. You must not impersonate someone else or provide account information or an email address other than your own. Your account must not be used for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction. Creatively by Donielle, LLC reserves the right to refuse service based on your provision of inaccurate account information.

Most all of the images on the Site are ours. Some images are not, and those are copyrighted and attributed to the respectful owners.

PERSONAL USE OF MATERIALS AND OUR INTELLECTUAL PROPERTY

The content on the Site is protected by United States trademark and copyright law. We reserve the right to immediately remove you from the Service, without refund, and to pursue all available legal remedies against you if you are caught violating this intellectual property policy.

You do NOT have the right to reprint or reproduce any of my materials on our Site or social media in order to resell the contents, including written works, audio and video, including giving it away, selling it, or sharing it. You may not use or share these materials as a tool with your clients, in your marketing or in any of the media you use in your business, or in any type of workshop, seminar, class, talk or training without prior express written permission.

REFUND POLICY

There are no refunds. All sales are final.

DISPUTE RESOLUTION

If we cannot resolve any issues within 30 days, you agree that the only method to be used for dispute resolution is binding arbitration before a single arbiter, selected jointly. You also agree that should arbitration take place, it will be held in Florida

MATERIAL YOU SUBMIT TO THE SITE

You shall not upload, post or otherwise make available on the Site any artwork, photos or other materials (collectively “Materials”) protected by copyright, trademark or other proprietary right without the express written permission of the owner of the copyright, trademark or other proprietary right. Creatively by Donielle, LLC reserves the right to remove from the Site any Materials submitted by you that it deems inappropriate for the Site or that appears to violate these terms and conditions.

We may at any time amend these Terms and Conditions. Such amendments are effective immediately upon notice to you by us posting the new Terms and Conditions on this Site. Any use of the Site or Service by you after being notified means you accept these amendments. TERMINATION

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Creatively by Donielle LLC should be construed as or relied upon as mental health or medical advice. Creatively by Donielle, LLC does not employ any mental health or law enforcement professionals and the information provided through our programs, workshops, products, Services, and materials are not intended to be a substitute for professional medical advice, diagnosis or treatment that can be provided by your own physician, nurse practitioner, physician assistant, therapist, counselor, mental health practitioner, licensed dietitian or nutritionist, member of the clergy, or any other licensed or registered health care professional.

LIMITATION OF LIABILITY

You agree that under no circumstances shall we be liable for direct, indirect, incidental, consequential, special, punitive, exemplary, or any other damages arising out of your use of the Site or Service. Additionally, Creatively by Donielle is not liable for damages in connection with (i) any failure of performance, error, omission, denial of service, attack, interruption, deletion, defect, delay in operation or transmission, computer virus or line or system failure; (ii) loss of revenue, anticipated profits, business, savings, goodwill or data; and (iii) third party theft of, destruction of, unauthorized access to, alteration of, or use of your information or property, regardless of our negligence, gross negligence, failure of an essential purpose and whether such liability arises in negligence, contract, tort, or any other theory of legal liability.

The foregoing applies even if Creatively by Donielle, LLC has been advised of the possibility of or could have foreseen the damages. In those states that do not allow the exclusion or limitation of liability for the damages, our liability is limited to the fullest possible extent permitted by law. In no event shall Creatively by Donielle ’s cumulative liability to you exceed the total purchase price of the Service you have purchased.

You acknowledge and agree that we are not responsible or liable for the availability, accuracy, content or policies of third party websites or resources. Links to such websites or resources do not imply any endorsement by or affiliation with Creatively by Donielle LLC . How do Creatively by Donielle memberships work?

Creatively by Donielle LLC offers subscription membership plans (“Membership(s)”) pursuant to which you will receive regular shipments of our socially conscious, specially curated lifestyle and other products. We offer multiple payment plans for Memberships; for example, we may offer a quarterly or annual payment plan. YOU ACKNOWLEDGE AND AGREE THAT YOUR MEMBERSHIP WILL AUTOMATICALLY RENEW UNLESS YOU CANCEL IT OR WE SUSPEND OR TERMINATE YOUR MEMBERSHIP/ACCOUNT IN ACCORDANCE WITH THESE TERMS. You understand that we will automatically charge your credit card on file for each applicable billing period (depending on which payment plan you’ve selected) until you cancel your Membership.

You may cancel your Membership at any time by contacting us at Hello@Truecrimetalks.club or by logging into your account, s and clicking ‘cancel’. Cancellation requests must be received prior to the billing date of the Membership renewal, or else you will be charged for the then-current billing period.

Creatively by Donielle LLC may, from time to time in its sole discretion, offer certain promotional codes for discounts and other benefits. You may not transfer promotional codes or redeem them for cash, credit, or toward previous purchases. Furthermore, you may not use promotional codes in conjunction with any other offer or promotional discount, and you must redeem promotional codes by the date published, if provided. Lost promotional codes cannot be replaced. You may only use one promotional code. Any promotional program may be terminated or modified by Creatively by Donielle LLC at any time in its sole discretion. Promotional codes are void where prohibited.

What terms govern my purchase of Memberships, Creatively by Donielle and other products through the Services?

While we will try to give you advance notice of any changes in our pricing and availability, we reserve the right to change our prices, available products, and Memberships at any time. Also, we may occasionally make errors in the stated prices on the Services. If a product’s or Membership’s correct price is inaccurately stated on the Services, we will, in our discretion, either confirm the correct price with you or cancel your order and notify you of such cancellation.

All sales are final and we do not allow returns or substitutions of products. We reserve the right to refuse or limit any orders and Memberships. We may refuse any cancellation requests for products and orders at our sole discretion. We reserve the right to provide substantially similar products to fulfill your order.

If you receive an incomplete order, please contact us at Hello@Truecrimetalks.club within two [2] weeks of receiving your order. We may offer replacements solely at our discretion.

We are no longer responsible for damage to your order or risk of loss once we deliver your order to the common carrier for shipment to you. Title to your order passes from us to you at the time we deliver your order to the common carrier. We reserve the right to choose any common carrier to ship your order to you. We may not be able to have your order shipped to a post office box, to certain addresses or on certain days. We reserve the right to ship your order in multiple boxes or shipments.

You authorize Creatively by Donielle, LLC and its payment processor to charge your payment card for all purchases you make, including automatically during each billing period for your Membership. You are responsible for providing us with complete and accurate personal and payment account information, and for keeping such information up-to-date. We may, in our sole discretion, cancel your payment at any time by providing notice to you through the contact information you have provided us in your account (such as your personal email address) or by a notice when you attempt to make a payment. We may cancel a payment or prevent you from making future payments for any reason, including, without limitation, (a) if you attempt to use the Services in breach of any applicable law or regulation; (b) if we suspect fraudulent, unlawful or improper activity regarding a payment; or (c) if you breach any of these Terms of Use or our Privacy Policy.

Our pricing does not include any customs duties, sales, use, value-added, excise, federal, state, local or other taxes. You are solely responsible for the payment of such taxes related to your purchase. We have the right to charge you for any taxes that we believe we are required to pay or collect related to your purchase.

Will Creatively by Donielle,LLC ever change the Services?

We’re always trying to improve the Services, so they may change over time. We may suspend or discontinue any part of the Services, or we may introduce new features or impose limits on certain features or restrict access to parts or all of the Services. We’ll try to give you notice when we make a material change to the Services that would adversely affect you, but this isn’t always practical. Similarly, we reserve the right to remove any Content from the Services at any time, for any reason (including, but not limited to, if someone alleges you contributed that Content in violation of these Terms), in our sole discretion, and without notice.

SMS, MMS, and other text messaging communications

Some of our services may allow you to receive SMS, MMS or other text message notifications from us (each, a “Text Message”). To the extent you voluntarily opt to have Text Messages from us sent directly to your mobile phone (in each instance, as applicable, the “Text Program”), the following additional terms apply:

You agree (i) to receive recurring automated marketing Text Messages from us about our digital and physical products, services and/or events that we think may be of interest to you at the phone number you provided, and that the messages may be sent via automatic telephone dialing system or other technology and (ii) to use and participate in the Text Program subject to Creatively by Donielle’s Terms of Use and Creatively by Donielle’s Privacy Policy.

Message frequency is recurring. Consent is not a condition of purchase. Reply STOP to opt-out and HELP for more information, including customer support. You understand and agree that attempting to opt-out by any means other than texting the opt-out commands above, or requesting via email to Hello@Truecrimetalks.club to be removed from our list, is not a reasonable means of opting out, except as required by law.

In addition to any fee of which you are notified, your mobile provider’s standard message and data rates may apply to our confirmation Text Message and all subsequent Text Message correspondence according to your individual rate plan provided by your wireless carrier. You represent that you are the owner or authorized user of the mobile device you use to subscribe for the Text Program and that you are authorized to approve the applicable charges. Under no circumstances will we be responsible for any text messaging or wireless charges incurred by you or by a person that has access to your wireless device or telephone number. If your carrier does not permit text alerts, you may not receive the Text Messages from us.

We will not be liable for any delays in the receipt of any Text Messages, as delivery is subject to effective transmission from your network operator. Text Message services are provided on an “AS IS” basis. Data obtained from you in connection with any Text Message services may include your cell phone number, your provider’s name and the date, time and content of your messages. We may use this information to contact you and to provide the Services you request from us.

You acknowledge and agree that you are not under the age of thirteen (13) years or are between the ages of thirteen (13) and eighteen (18) and have your parent’s or legal guardian’s permission to use and participate in the Text Program.
